The Pregnancy Discrimination Act amending Title VII was enacted in 1978. More than 35 years later, the EEOC and the courts are still struggling to determine what it means in the workplace and how pregnant employees should be treated under various other laws. Last year alone over 5,342 charges of pregnancy discrimination were filed, and pregnancy discrimination is now a major priority for the EEOC. In fact, the Commission issued its first Guidance in 30 years on this topic on July 14, 2014. This Guidance and the Pregnancy Discrimination Act will be the focus of two upcoming Baker Donelson Breakfast Briefings.
In Part I, on August 21, 2014, we will discuss the EEOC Guidance and topics relating to the Pregnancy Discrimination Act coverage; evaluating PDA-covered employment decisions; equal access to benefits; and the issues in the pending Supreme Court case, Young v. United Parcel Service.
In Part II, on September 18, 2014, we will discuss how pregnancy is treated by the EEOC under the Americans with Disabilities Act, as amended and the Family and Medical Leave Act; other requirements affecting pregnant workers; some state laws; and best practices for employers.
