Tennesseans were recently slated to vote to retain or unseat three of the state's Supreme Court justices. In this Nashville Business Journal article, Charles Grant, president of the Nashville Bar Association (which has urged its members to retain the three justices), discusses what is at stake for businesses amid the battle. Mr. Grant said keeping the courts nonpartisan and independent is paramount. Ensuring that independence in the court is key for businesses, he said, because "businesses rely on precedent and expectations." In other words, businesses want to know what to expect from the state's highest court, knowing that it won't swing too far one direction too quickly because of factors outside the law.
"No business wants to be in court where it is uncertain whether the court is independent," Mr. Grant said. "When you do not know what is motivating the court because it is not demonstrably independent that causes uncertainty ... that undermines business expectations."
