Scott Carey, managing shareholder of Baker Donelson's Nashville office, talks with the Nashville Business Journal about both sides of the litigation coin. If your company is sued, Mr. Carey says to contact your insurance company and a lawyer to coordinate your defense. He says in order to protect your company during litigation, it is important to take every case seriously, even if you think it is frivolous.
If your company decides to sue, Mr. Carey says, "Litigation should be your last resort. Be sure you understand the costs associated with litigation. You also should understand the end game. If the cost of inaction outweighs the cost of litigation and you are comfortable with the risks … and you have exhausted all other options, a lawsuit may be the only way to resolve the dispute."
