Recent EEOC actions highlight the agency's commitment to curb the alleged discriminatory impact of employers' use of criminal background checks. Described by one federal court as a "Hobson's Choice," the EEOC's guidelines regarding the acceptable use of criminal background checks provide little guidance to employers seeking to balance compliance with the EEOC guidelines and implementing practices to limit their liability for potential criminal or fraudulent acts. State and local governments are similarly working to limit the use of criminal background checks with the passage of "Ban the Box" legislation prohibiting employers from using criminal background checks as part of the hiring process. Together, these restrictions on background checks have the potential to sneak up on the unsuspecting employer. This month's Breakfast Briefing will review recent litigation in which the employers' hiring practices were the subject of EEOC scrutiny, discuss the impact of the "Ban the Box" campaigns, and provide best practices for employers to avoid potential liability.
