The decision of whether to request or agree to arbitration is a very important tactical decision. A thorough analysis requires possible litigants to consider a variety of issues and weigh the pros and cons of arbitration against the attributes of traditional litigation. This program will explore most of the issues which arise in this context and conclude with a discussion of some of the provisions of the arbitration agreement which should be considered if arbitration is chosen.
