Bryan Scott is a seasoned litigator who has litigated cases in federal and state appellate courts, tried jury and bench trials, and handled arbitration and administrative hearings.

Bryan represents a wide range of clients in the construction industry, including public and private owners, developers, contractors, lenders, and insurers. He provides practical advice to clients on projects involving commercial, public, and multifamily construction; schools; hospitals; bridges and roadways; site development; slope stabilization; pipelines; and wastewater systems, among others. His experience covers contracting, lending, and bidding matters; compliance and operational concerns; and resolving disputes through trial, arbitration, or other means. These disputes often involve mechanics' liens and payment issues, cost impact and delay claims, defective design claims, insurance coverage, licensing, and related matters. He has represented licensees in disciplinary proceedings before the North Carolina General Contractor Licensing Board, the Private Protective Services Board, and the Commissioner of Insurance.

Bryan also handles commercial litigation and creditors' rights matters covering a range of areas, including contract disputes, collections and foreclosures, lender liability, title issues, insurance coverage, warranty claims, secured transactions, patent and trademark infringement, unfair trade practices and competition, shareholder disputes, fiduciary claims, and products liability. He has represented numerous community, super-regional, and national banks and credit unions in litigation and foreclosure proceedings related to distressed commercial loans involving both commercial and residential properties.

Bryan has extensive experience representing insurers and insureds in complex insurance coverage and bad-faith litigation, including matters arising from commercial general liability, errors and omissions, automobile, and workers' compensation policies.

  • Construction

  • Represented an owner as project counsel and in a three-week arbitration hearing over construction claims related to a $66 million student housing project.

  • Represented a public owner in a bid protest and federal litigation arising from alleged delay and construction defect claims involving construction of a $20 million wastewater treatment plant.

  • Represented multiple local municipalities and the states of North Carolina and Virginia in negotiation and administration of construction contracts for new school construction.

  • Obtained summary judgment, affirmed on appeal after oral argument, on construction lien claims brought against a community banking client.

  • Represented a regional health system in negotiating contracts for construction of a new $39 million cancer center.

  • Represented a regional health system in construction defect disputes related to a clinical teaching center and outpatient surgery center projects.

  • Obtained a defense verdict for a national home warranty company in arbitration proceedings over a structural warranty claim for alleged foundation system defects.

  • Represented a specialty subcontractor in cost-overrun claims on a high-profile emergency highway rockslide stabilization project.

  • Represented a major industrial manufacturer in ground lease litigation involving environmental contamination.

  • Represented an international manufacturer as project owner in cost-overrun claims by a contractor related to industrial piping installation.

  • Represented a general contractor in cost-overrun and delay claims against a municipality, as well as product-liability claims against a piping manufacturer, all arising from a nine-mile force main sewer project.

  • Intellectual Property

  • Represented a national fast-casual restaurant chain in a trademark infringement action challenging a tagline used by a competing restaurant chain.

  • Defended a highway contractor in a patent infringement action related to accused slab-leveling and soil-stabilization methods.

  • Served as local counsel to a leading research university and a pharmaceutical manufacturer in Hatch-Waxman patent infringement litigation.
