Last fall, the U.S. Supreme Court formulated a new test for conceptual separability based upon its own reading of the U.S. Copyright Act instead of adopting previous tests developed by the lower courts. Join us to explore and compare the old conceptual separability tests and sort through a series of useful objects bearing applied art features to determine if copyright protection attaches.
