Jury Trial Victory for Investor in Breach of Contract Litigation

Breach of Contract Litigation

Client: Retired Medical Doctor
Type of case: Breach of Contract
Court: Federal District Court, Northern District of Alabama
Length of trial: Three days
Amount in dispute: Approximately $300,000
Result: Summary judgment on plaintiff claims and positive jury verdict on counterclaims

Our client is a retired doctor who lives in California and invests in mobile home parks. We first represented him as a plaintiff in a breach of contract claim, and were awarded more than $280,000 on summary judgment.

We then proceeded to a three-day federal jury trial, defending counterclaims for breach of contract, negligence, unjust enrichment, fraud, waste, specific performance, and constructive trust. The opposing party sought $300,000, but was awarded only $21,500 on his breach of contract claim. Ultimately, our client netted approximately $260,000 from both proceedings.

This case is noteworthy because it was tried by a young associate, which demonstrates the Firm's commitment to providing younger associates with actual trial experience early in their careers.
