Working knowledge of obligations under the Family and Medical Leave Act, the Americans with Disabilities Act, and similar state laws, is a must for employers in today’s climate, and engaging with employees in a timely and effective manner plays a significant role in protecting business interests. Today’s FMLA and ADA issues are even more complicated and complex. While the FMLA and the ADA have been in play for many years, recent developments in the courts and at the agencies that enforce these laws mean that Human Resources professionals need the knowledge and insight to handle increasingly challenging leave management issues in the workplace. Simple solutions are no longer the norm and the costs for even the slightest mistakes can be substantial, and even HR professionals and managers can be individually sued for violations.
This session covers the basics, updates, and interplay of the FMLA and the ADA and informs participants about best practices related to managing complex leave issues, including recent trends related to leave management, and common mistakes and risks arising from improper management of leave issues. The session will conclude with a comprehensive and interactive workshop where participants will tackle the most frequent and challenging leave management problems (such as FMLA eligibility and designation issues, FMLA abuse issues, return to work issues, and ADA extended leave issues) using our unique three-step model for analyzing such problems.
