Professional Biography


Max Cadmus represents clients in insurance coverage, antitrust, and unfair competition disputes; administrative appeals; and business, products liability, and professional liability litigation. He practices in a wide range of industries including health care and life sciences, financial services, retail, technology, media, and telecommunications. Max defends clients before state and federal courts, arbitration panels, and administrative agencies.

Prior to private practice, Max served as a law clerk to The Honorable Jerome M. St. John of the New Jersey Superior Court, Appellate Division. During law school, he was a judicial intern to The Honorable Dennis F. Carey, III, Presiding Judge of the New Jersey Superior Court, Essex Vicinage, and then to The Honorable Jose L. Linares, Chief Judge of the U.S. District Court for the District of New Jersey.

  • Won an Appellate Division victory that revived a hospital's claims for unfair competition and conspiracy against a competitor.

  • Successfully quashed an invasive subpoena seeking a company's pricing and sales strategy in connection with an antitrust lawsuit involving large East Coast retailers and developers.

  • Won summary dismissal of claims brought by a competitor against an industrial supplier alleging violation of New Jersey's Local Public Contracts Law.

  • Represented a New Jersey advocacy organization as amicus curiae before the New Jersey Supreme Court. The court rejected a punitive damages claim against physicians and a hospital for using a power morcellator to treat a patient after the FDA issued a safety communication against its use. The patient passed away from a rare cancer post-hysterectomy. The plaintiffs argued the physician should have suspected cancer and informed the patient of the risks. The trial court denied summary judgment on punitive damages, but the Supreme Court found insufficient evidence of malice or wanton disregard by the doctors or hospital.

  • Served as lead trial counsel for a Silicon Valley and Japanese hardware component manufacturer in an international theft of trade secrets claim involving the design of microprocessors and arising in China. The case was settled on a confidential basis prior to trial in the U.S. District Court for the District of Delaware.

  • Represented a New Jersey hospital in unfair competition claims against a competing hospital system.
