Mr. Bishop is an experienced litigator defending his clients' intellectual property rights at all stages of litigation in federal and state courts. He leverages his trial experience to serve as a trusted advisor to clients navigating the complexities of IP litigation and provides actionable, tactical advice.

Mr. Bishop's intellectual property experience includes patent, trademark, copyright, trade secret, unfair competition, and restrictive covenant disputes involving individuals and corporations, including declaratory judgment and infringement actions.

Mr. Bishop is also an experienced appellate lawyer. His appellate experience includes successfully defending trademark and software rights in ownership disputes and developing new law on issues of first impression in state and federal courts of appeal.

He also assists clients in high-stakes business and commercial disputes, including class actions.

Mr. Bishop practices extensively in federal and state courts throughout the country, including before the United States Court of Appeals for the Federal Circuit, the Judicial Panel on Multidistrict Litigation, and the Trademark Trial and Appeal Board.

  • Intellectual Property

  • Litigated a patent infringement matter for a dietary supplement manufacturer.

  • Assisted in the representation of a nationally recognized flooring manufacturer in an infringement matter.

  • Obtained a $5.4 million judgment against a trademark infringer.

  • Obtained the cancellation of a federally registered trademark in favor of a common law holder before the Trademark Trial and Appeal Board.

  • Obtained an injunction against a trademark infringer and copycat website.

  • Obtained summary judgment affirming a client's ownership of a disputed trademark.

  • Successfully defended against an attempt to enjoin use of a trademark for a client's flagship brand.

  • Represented a client in an authorship dispute for a children's book.

  • Business Litigation/Class Action

  • Served as lead associate in successful defense of an attempt to bring lenders into multidistrict litigation on "agent fees" arising out of the COVID-19 Paycheck Protection Program (PPP).

  • Assisted in the defense of a foreign manufacturer in a putative class action alleging false advertising.

  • Served as lead associate in drafting the winning motion for distribution of more than $100 million in settlement funds to class members in products antitrust litigation.

  • Assisted in preparing winning defense briefing in class action challenging patronage capital practices of 38 electric membership corporations.

  • Appellate

  • Successfully represented a client in an appeal challenging ownership of disputed software before the United States Court of Appeals for the Eleventh Circuit.

  • Assisted in winning affirmance of dismissal of wrongful death case alleging electric utility failed to maintain adequate street lighting.

  • Served as lead associate in drafting Petition for Discretionary Appeal to Georgia Court of Appeals on an issue of first impression in Georgia environmental law.
