Brent B. Young advises creditor clients in bankruptcy and debt restructuring issues across the country, with an emphasis in the two states where he is currently licensed: Tennessee and South Carolina.

Represented an international chemical company in a $500 million commercial dispute in federal court. Representation included co-chairing a multi-layered team of litigators, including the implementation of a document review process of thousands of electronic documents, discovery and motion practice.
Represented international finance company in mold abatement case, serving as defense counsel. The case was comprised of 75 plaintiffs. Ultimately Baker Donelson negotiated a successful settlement of the case for the client.

Professional Biography


Mr. Young has twenty years of experience in more than one hundred commercial loan work-out and recovery matters. He is based in the Firm's Johnson City office, and has worked extensively with special servicers in wide-ranging CMBS and other related matters including foreclosure (judicial and non-judicial), receiverships, defense of borrower litigation, guarantor recovery, and analysis of rights and duties of parties to pooling and servicing agreements.

In addition to his creditor practice, Mr. Young has defended dozens of employers against claims of discrimination and other litigation matters. He has likewise counseled dozens of companies of all sizes on the enforcement of covenants not to compete, negotiated severance and separation agreements, and helped draft employee handbooks and employment applications. Mr. Young has extensive experience in commercial, business, premises liability, long term care, personal injury, and products liability litigation.

Mr. Young also represents clients in the transportation industry and is a member of the Firm's 24 Hour Motor Carrier Emergency Response Team, a group of attorneys dedicated to providing rapid post-accident intervention and investigation throughout the Firm's footprint and beyond, whenever and wherever clients need us.

Mr. Young serves on the Firm's Pro Bono Committee and serves as office pro bono coordinator in the Tri-Cities, TN/VA office. He is a frequent presenter at seminars on most employment topics and professional ethics issues and is bilingual (English and Spanish), conducting training and investigations in both languages.

  • Led team of dozens of attorneys to a highly favorable result in a bet-the-company litigation on a dispute involving two publicly traded companies over a $1 billion supply contract. Related issues included reciprocal lawsuits in two jurisdictions, seeking and obtaining expedited relief under the Declaratory Judgment Rule, and alleged spoliation of evidence. Dozens of depositions, hearings and rulings were prosecuted/obtained during the course of a highly condensed 90-day litigation schedule, ending with a settlement on the courthouse steps.

  • Instrumental in obtaining revision to owner-operator truck driving statutes in South Carolina relative to workers' compensation benefits through ongoing litigation on several matters and at different levels of courts.
  • Represented a chemical company in a dispute with one of its largest suppliers over a multi-year contract with a value in excess of $1 billion. Given the unique nature of the product, it was imperative that our client be granted relief on an expedited basis. We were successful in setting a trial date just two months after the lawsuit was filed. The Firm participated in more than twenty depositions and more than twelve hearings. The parties eventually settled at a third session of court-ordered mediation on the eve of trial, resulting in a net benefit for the client over $140 million.
  • Successfully mediated settlement of a complex sexual harassment and pay discrimination lawsuit on behalf of international telecommunications company.
  • Represented international finance company, successfully mediating the settlement of a complex sexual harassment and age discrimination lawsuit.
  • Successfully defended an international auto parts company in a FMLA and age discrimination case that was dismissed on summary judgment.

  • Successfully defended international chemical company in a personal injury lawsuit. While waiting on the judge to rule on 10 pre-trial motions in limine, opposing counsel settled for a nominal amount.
  • Conducted multiple investigations of correctional centers, including issues surrounding medical departments and inmate escapes.
  • Represented client in litigation related to a $5 million beach house in Hilton Head Island, South Carolina. Successfully negotiated the settlement of the lawsuit, resulting in a $1 million benefit to the client.
  • Represented a financial services client, successfully negotiating a consensual Chapter 11 Plan, resulting in significant future profit for the client. The Plan was finalized after close to three years of state court and bankruptcy litigation.
  • Successfully represented a communications company against a former management employee's allegations of disability and age discrimination. Prepared and filed counterclaims seeking disgorgement of severance pay, compensation for breach of loyalty, and lost profits resulting from shirking of management responsibilities. Resolved the complaint and the counterclaims through dismissal with prejudice.
